The clip shows Tolan appearing to use the hands-free function on his phone as he smirks. He was also seen joking with others and carrying a large overnight bag as he waited to enter the building.‌Tolan later sobbed in the dock as he was jailed for nine years over the horror crash in Sheffield, on January 25, 2024. He was also banned from driving for 10 years. In addition to speeding at 58 miles per hour when he hit Ms Smart as she attempted to cross the road, Tolan was not wearing his glasses - in spite of licence conditions.‌Judge Jeremy Richardson KC said he believed Tolan, of Birley, Sheffield, showed an "errant disregard and arrogance" for the rules.
