Stephen Gressey was thrown from a portable toilet while working on the TSX Broadway tower in Times Square in 2023 after it 'collapsed' on him, a suit claimed. The suit, filed in Manhattan Supreme Court and seen by The New York Post, said that Gressey, an ironworker, was sent flying to the curb - causing him injury. According to the lawsuit, filed against Rent A Throne, the portable toilet 'tipped over, rolled and fell off a concrete grub'. As it did, Gressey was 'catapulted out to the concrete ground below', which the suit claimed caused him serious injuries. As such, he was left out-of-work and confined to his bed, with the injuries causing a strain on his wallet due to rising medical bills and on his sex life with his wife Janet, the suit said. It added: 'Her happiness in his society has been impaired. '[She] lost the support, services, love, companionship, affection, society, sexual relations, solace of her husband.' At the time, Gressey was working for construction contractor Gamma USC when the incident in May of 2023. He is now seeking monetary damages through the lawsuit from Rent A Throne, but it does not specify how much. The suit said: '[Rent A Throne] failed to ensure the proper location and placement of the porta-potty and failed to provide and place any securing devices to keep the porta-potty from moving, rolling, shifting tipping and collapsing.' This is the second time he has sued for the same incident, having previously gone after the developer, property owner and contractors. The case is still ongoing. Defendants filed motions saying that Gressey was 'recalcitrant' and frequently failed to use safety equipment. They also said that he 'voluntarily' entered the toilet and knew the 'risks' involved in doing so. No comments have so far been submitted.
