Matt Vickers has launched a scathing attack on the Labour Government after publishing a document for asylum seekers on how "not to rape women and girls".
Speaking to GB News, the Shadow Crime Minister hit out at the "disgusting" Home Office guidance, declaring it is "not the solution" to Britain's migrant crisis.
In the Home Office document, asylum seekers are warned that breaking these laws could lead to prison, the loss of their support and accommodation, and an adverse effect on their asylum claim.
Describing the "serious crime" of rape, the guidance lays out what consent is: "In the UK, both people must say ‘yes’ to sex. This is called consent."
The information made it clear it is still rape if you are "married to the person or in a relationship" and if a person "agreed once but changed their mind".
Expressing his outrage at the document, Mr Vickers told GB News that it is "evidence of complete and utter failure" by the Government.
He said: "If we've got people coming into this country who we think are incapable of treating children and women properly, then they shouldn't be coming into this country. It is not acceptable.
"This is no solution to allowing illegal migrants to come to this country and commit crimes. Those sort of people should not be here. If you arrive in this country illegally, you should not be allowed to stay."
Mr Vickers made clear that Labour must "leave the ECHR" in order to implement any effective deterrent to illegal migrants.
He argued: "We need to detain and deport anybody who arrives illegally, or anybody who has arrived legally and committed a crime. It is not acceptable. This is no solution to any problem to have pamphlets dished out, it's disgusting and completely unacceptable.
"And with Starmer, we saw a record number of people arriving in the country illegally, more than under any previous Prime Minister. This Prime minister has been there a month, virtually, and 3,500 more people have arrived in this country illegally.
"They've broken into this country. The Prime Minister needs to be concentrating on that and needs to be losing sleep about how we solve that problem."

Challenging Mr Vickers, host Stephen Dixon highlighted that documentation such as the Home Office's have been "dished out for years", even under the Tories.
Mr Vickers hit back: "There's material that might have explained the law or their expectations of the UK, but it's very different to telling people that it is not acceptable to rape somebody, to have sexual intercourse with a child. This is absolutely nuts.
"It's an indicator of how badly out of control our borders are, it's just not acceptable. This situation is out of control. The answer is probably quite simple actually, if you arrive in this country illegally, you must be detained, you must be deported."
He added: "And if the ECHR wants to get in the way of that, we need to leave the ECHR. Everybody at home knows that is the solution. People getting in those boats need to know they're not going to be allowed to stay.
"That is the only way to stop this. Pamphlets aren't solving the crimes being committed by illegal migrants."
Responding to the controversy surrounding the document, the Prime Minister said: "As a Government, we have a very clear principle.
"If you break UK law, you will be removed from the country. We have seen that in relation to immigration, where removals are significantly up.
"I'm currently working to ensure that foreign national offenders who can be removed from the prison system are removed from that system. So it follows that if we're taking this approach, people are made.
"It's made explicitly clear what the UK law is and what the societal norms of the UK are, and that's why this approach is being taken."
