2023'teki Aksa Tufanı Operasyonu'na katıldığı iddia edilen Filistinlilerin yargılanması için hazırlanan "7 Ekim Olaylarına Katılanların Yargılanmasına İlişkin Yasa Tasarısı"nı kabul ederek özel askeri mahkeme kurulması ve Filistinlilere idam cezası verilmesinin yolunu açtı. İsrail Meclisi tarafından kabul edilen yasayla, üyelerinin özel atamalarla belirleneceği bir askeri mahkemenin kurulması ve 7 Ekim 2023'te İsrail'de esir alınarak gözaltı merkezlerinde ağır şartlarda tutulan 300 civarında Filistinlinin bu mahkemede yargılanması kararı alındı. İsrail Meclisinin, mart ayında İran'a saldırıların gölgesinde, Filistinli esirlere idam cezası getirilmesini öngören tartışmalı yasa tasarısının ardından 120 sandalyeli İsrail Meclisi'nde 93 evet oyuyla onayladığı bu yeni yasa da hukuk ilkelerine yönelik ihlaller nedeniyle eleştirilere yol açtı. Yasa kapsamında kurulması planlanan söz konusu özel askeri mahkeme, üzerinden yaklaşık 3 yıl geçmesine rağmen 7 Ekim 2023'teki Aksa Tufanı Operasyonu'na katıldığı iddia edilen Filistinlilere, "soykırım" suçlamasıyla idam cezası verebilecek. İsrail'in The Jerusalem Post gazetesi, İsrail Meclisinin, Filistinli esirlere idam cezası getirilmesini öngören tartışmalı yasa tasarısını martta onaylasa da, bu yasanın geriye dönük uygulanamayacak olması nedeniyle, 7 Ekim 2023'teki Aksa Tufanı Operasyonu'na katılan Filistinlilere idam cezası verilebilmesinin önünü açmak için bu yeni yasa tasarısını hazırladığını kaydetti. Yasaya göre, askeri mahkeme, 7-10 Ekim tarihleri arasında "saldırı", "İsraillileri esir alarak Gazze'ye götürme" gibi suç isnatlarıyla olaylara katıldığı öne sürülen Filistinliler hakkında iddianame düzenleyecek. Filistinlileri, İsrail'in 1950 tarihli Soykırımı Önleme Yasası kapsamında "soykırım", İsrail'in egemenliğine zarar verme, savaşa neden olma, savaş sırasında düşmana yardım etme" ile 2016 tarihli "Terörle Mücadele Yasası" kapsamında "terör" suçları dahil olmak üzere ilgili suç isnatlarıyla yargılayacak olan mahkeme, "Soykırımı Önleme Yasası" kapsamında soykırım suçlamasıyla mahkum edilen Filistinlileri idam cezasına çarptırılabilecek. Ayrıca, 7 Ekim'e katıldığı iddiasıyla "şüpheli, sanık veya hükümlü" sıfatındaki Filistinlilerin hiçbirinin, esir takası anlaşmasıyla serbest bırakılmaması yönünde bir madde de yasada dikkati çekti. İsrail, söz konusu yasayı, "soykırım" ve "Yahudi halkına karşı işlenen suçlar" temasıyla "modern Eichmann davası" olarak temellendirmeye çalışıyor. Adolf Eichmann, İsrail'de yasal olarak en son idam cezasının uygulandığı, Nazi Almanyası'nda görev yapmış bu dönemdeki Yahudi soykırımının (Holokost) üst düzey bir subayı olarak biliniyor. "Yahudi halkına karşı suçlar"dan 1961'de yargılandığı davada mahkum edilerek idam cezasına çarptırılan Eichmann 1 sene sonra 1962'de idam edildi. "7 Ekim Olaylarına Katılanların Yargılanmasına İlişkin Yasa Tasarısı"nı sunan İsrail Evimiz Partisi milletvekillerinden Yulia Malinovsky de, yasanın görüşülmesinden önce İsrail Meclisi'nde düzenlenen basın toplantısında, söz konusu yasanın "modern Eichmann davası" olduğunu iddia etti. "7 Ekim Olaylarına Katılanların Yargılanmasına İlişkin Yasa", Filistinlilerin yargılandığı duruşmaların, halka açık yapılması ve özel olarak kurulacak bir internet sitesinden canlı olarak yayınlanmasını öngörüyor. Bu maddenin, yayın yasağına ilişkin hükümleri geçersiz kılmayacağı belirtilen yasada, temyiz duruşmalarının internet sitesinde yayınlanıp yayınlanmayacağına ise temyiz mahkemesinin karar vereceği kaydediliyor. İnsan hakları ve hukuk örgütü "Adalah" ve İsrailli insan hakları örgütlerinden "HaMoked", 7 Ekim 2023'ün "üzerinden yaklaşık 3 yıl geçmesine rağmen 300'den fazla Filistinli esirin sistematik işkence altında, herhangi bir suçlama olmaksızın tutulmaya devam ettiği" belirtilen ortak açıklamalarında, yasanın bu tutukluların yargılanmasını amaçlayan "istisnai bir yasal çerçeve" oluşturduğunu kaydetti. Açıklamada, özel atamayla belirlenecek bir heyetin yargılamayı adil yürüteceğine dair şüphelere neden olduğu kaydedilirken "Mahkemenin ölüm cezası verme yetkisi ve yasa koyucuların Gazze'den yüzlerce Filistinliye karşı bunu yapacağı yönündeki beklentileri göz önüne alındığında yasa karşısında endişeler daha da artıyor." ifadelerine de yer verildi. Öte yandan, Birleşmiş Milletler (BM) Filistin Özel Raportörü Francesca Albanese, BM'nin terörle mücadele konularında insan hakları özel raportörü Ben Saul ve BM Yargıç ve Avukatların Bağımsızlığı Özel Raportörü Margaret Satterthwaite, sene başında, yasaya ilişkin insan hakları ile yargı bağımsızlığı ve tarafsızlığı açısından endişelerini İsrail'e bildirdi. BM raportörleri, yargıya siyasi müdahaleden de endişe duyduklarını kaydederek, raporlarında "Tasarının, bağımsız ve tarafsız bir mahkeme tarafından adil yargılanma hakkı, yaşam hakkı, özgürlük hakkı, işkence ve diğer kötü muamelelerden korunma hakkı, ayrımcılığa uğramama ve eşitlik hakkı da dahil olmak üzere uluslararası insan hakları hukukuyla bağdaşmayan ceza davalarına yol açabileceğinden endişe duyuyoruz." ifadelerine yer verdi.
