How 'incest' mom charged with having sex with her two adopted teen sons was finally snared... as her twisted text messages to boys are revealed

Amber Swain, 35, was arrested last month after her husband Daniel, who she is separated from, filed a report with Washington's Department of Children Youth and Families flagging his suspicions about her relationship with the two boys, aged 17 and 18. She has pleaded not guilty. Swain's estranged husband even handed police a slew of twisted text messages that helped build the case against the longtime foster care advocate, court documents obtained by the Daily Mail show. In one of the texts, one of Swain's adopted sons told her that he wanted to sleep in her bed again, saying he wanted 'it to happen again. Just once.'  'No,' she said. 'I love you so much,' Swain replied, according to the probable cause affidavit. 'Nothing like that is ever going to happen. You will find someone who you love being with like that and care about.' Swain, who was previously an executive director of Spokane Angels – a nonprofit supporting child in the foster care system – was arrested on June 2 just weeks after her estranged spouse first alerted authorities.  She is accused of beginning a sexual relationship with at least one of the boys in December last year when he was just 17.  Amber Swain, 35, was arrested last month after her estranged husband Daniel filed a report with Washington's Department of Children Youth and Families flagging his suspicions Swain, who has three adopted children and three biological kids, was hit with a spate of charges, including incest and sexual misconduct with a minor The school teacher from Newport, Washington, had adopted one of the boys after first meeting him as a struggling third grader in her classroom back in 2017, according to authorities. During subsequent police interviews with the boys, one of the teens alleged he'd had sex with his mom 'many times' – with the most recent encounter just two days earlier, the court documents state. The boy said Swain had allegedly asked him, 'Should we be doing this?', during their first encounter and he responded, 'Yes'.     The teen who messaged Swain saying he 'wanted it to happen again' told investigators he first grew suspicious that his mom was also having sex with his sibling after finding her underwear on his brother's bedroom floor and discovering the two of them locked in a room. He claimed he fell asleep in Swain's bed one night and woke to find her climbing in beside him, which he claimed was 'normal' for them as they had 'cuddled since he was young', the court documents state.  'Things got handsy, that's all I'm going to say,' he said when officers probed further about the alleged incident. He described putting his hand inside Swain's clothing and that they 'changed positions several times'. After about two minutes, he said that she moved his hand away and told him they could not do this and stopped. She later said the boy had touched her leg while she was asleep and that she froze and moved it away twice. Eventually, she told cops she did not know why but she 'leaned in,' adding that she was 'like half asleep or something' before pushing his hand away.   Swain initially denied any sexual relationship with the other boy but eventually admitted to having sex with him starting in February of this year, according to the affidavit.  Detectives informed her the victim had stated it started in December, making him 17 at the time, to which Swain insisted his timeline must be wrong. Officers noted that his 18th birthday was in January, with Swain then allegedly switched her story again, claiming that her timeline could be wrong. No-contact orders obtained by the Daily Mail show the younger of the alleged victims was 16 at the time of Swain's arrest.   After Swain admitted to the relationship with the boy, investigators told her they were seizing her phone. Swain's estranged husband handed police a slew of twisted text messages that helped build the case against the longtime foster care advocate In the wake of her arrest, Swain was placed on administrative leave from Pend Oreille River School She objected, telling them they had no right to take it without a warrant, with the affidavit describing her as 'agitated'. The teacher was ultimately booked on a spate of charges, including incest in the first degree, incest in the second degree, and sexual misconduct with a minor in the first degree.   Swain, who pleaded not guilty at her arraignment on June 8, faces up to 10 years in prison if convicted on the most serious count. In the years before her arrest, Swain posted videos to Facebook encouraging others to consider fostering and adoption. In one clip, she described falling for the boy who would later become her adopted son. 'Throughout the year, I just grew to love him,' she said. 'I saw his resilience, his potential and just grew to love him. He really inspired my husband and I to start fostering.' Swain and her now-estranged husband ended up caring for that little boy and his brother. The following year, the couple started fostering a third boy before adopting all three in November 2019. They also have biological children together. In the wake of her arrest, Swain was placed on administrative leave from Pend Oreille River School, the Newport School District's alternative high school. She is due to face trial on October 6.
