Ağır Ceza Mahkemesi'ndeki duruşmaya, 4'ü tutuklu 5 sanık ile tarafların avukatları ve hayatını kaybeden Böcek ailesinin yakınları katıldı. Tutuklu 1 sanık ise Ses ve Görüntü Bilişim Sistemi (SEGBİS) ile duruşmaya bağlandı. Duruşmaya tutuklu sanıkların kimlik tespitiyle başlandı. İstanbul Cumhuriyet Başsavcılığınca hazırlanan iddianamede, Kadir Muhammet Böcek (6), Masal Böcek (3), anne Çiğdem Böcek ile baba Servet Böcek "maktul", 2 kişi "müşteki" ve 6 kişi ise "şüpheli" olarak yer alıyor. İddianamede, Fatih'te 13 Kasım 2025'te yaşanan zehirlenme olayında Çiğdem Böcek, Kadir Muhammet Böcek ve Masal Böcek'in zehirlenme sonucu hayatlarını kaybettiği ve aynı olaydan dolayı tedavi gören baba Servet Böcek'in de 17 Kasım 2025'te hayatını kaybettiği anlatılıyor. Hayatını kaybeden maktullerin sağlık durumu nedeniyle beyanlarının alınamadığı, olayın ilk aşamada gıda zehirlenmesi sebebiyle olduğunun değerlendirildiği belirtilen iddianamede, mağdurların olay öncesi yemek yediği yerlerle ilgili olarak soruşturmanın genişletildiği, bu kapsamda mağdurların kokoreç, midye, lokum, unlu mamul yedikleri ve meşrubat içtikleri işletme sahiplerinin tespit edildiği belirtiliyor. İddianamede, tespit edilen iş yerlerindeki ürünlerden alınan örneklerin İlçe Tarım ve Hayvancılık Müdürlüğüne teslim edildiği, dosyaya gelen Adli Tıp İhtisas Kurulu Raporu'na göre maktullerin ölüm sebebinin kaldıkları oteldeki böcekleri öldürmek için uygulanan ilaca bağlı zehirlenmeden kaynaklandığı kaydediliyor. Olayın yaşandığı oteli ilaçlayan şüpheli Doğan Cağferoğlu'nun, herhangi bir sertifika kaydına rastlanmadığı ve izinsiz olarak biyosidal ürün uygulaması yaptığı raporda anlatılıyor. 1. Adli Tıp İhtisas Kurulu tarafından hazırlanan otopsi raporuna göre, kişilerin ölümünün kalmakta oldukları otelde böcekleri öldürmek amacıyla uygulanan ilaca bağlı zehirlenme sonucu meydana geldiği iddianamede yer alıyor. İddianamede yer verilen bilirkişi raporunda, yaşanan olayda ölümlerin gıda zehirlenmesi sonucunda gerçekleşmediği, bu nedenle dosyada adı geçen gıda işletmelerinin olayda herhangi bir kusurunun bulunmadığı belirtiliyor. Bilirkişi raporunda, yanlış kimyasal (Alüminyum fosfit) kullanılması, yetkisiz personel çalıştırılması ve gerekli güvenlik önlemleri alınmadan işlem yapılması nedeniyle, sertifikasız ve izinsiz faaliyet gösteren ilaçlama firması yetkilileri şüpheliler Zeki Kışı ve Serkan Kışı'nın asli kusurlu oldukları iddianamede belirtiliyor. İddianamede, ilaçlama firması çalışanı şüpheli Doğan Cağferoğlu'nun ilaçlama konusunda herhangi bir sertifikası, bilgisi ve deneyimi olmamasına rağmen işlemi gerçekleştirdiği için asli kusurlu olduğu aktarılıyor. Otelin sahibi şüpheli Hakan Oğlak'ın yetkisiz ve ehliyetsiz kişilerle çalışarak, uygun olmayan biyosidal ürünlerle, iş sağlığı ve güvenliği önlemleri alınmaksızın ilaçlama faaliyetinin yürütülmesine onay verdiği, kimyasal risk içeren ilaçlama işlemi sırasında oteli tahliye etmeyip acil durum personeli bulundurmayarak konaklayanların can güvenliğini sağlama konusundaki özen yükümlülüğünü ağır biçimde ihlal ettiğinden asli kusurlu olduğu iddianamede yer alan raporda belirtiliyor. Hazırlanan iddianamede, şüpheliler Serkan Kışı, Zeki Kışı, Doğan Cağferoğlu, Hakan Oğlak ve Muhammad Moeen Ud In Chıshtı'nın, "bilinçli taksirle birden fazla kişinin ölümüne neden olma" suçundan 2 yıl 8 aydan 22 yıl 6'şar ay hapisle cezalandırılmaları talep ediliyor. İddianamede, Rustemsha Batyrov hakkında ise "taksirle birden fazla kişinin ölümüne neden olma" suçundan 2 yıldan 15 yıla kadar hapis cezası isteniyor.
