Jorge Luis Alverio Nunez was on board Carnival Magic in May last year when he burned the bottoms of his feet while walking from the deck chairs to the pool, according to a lawsuit filed in Florida on May 13. 'While a passenger may reasonably expect an exterior deck surface exposed to sunlight to become warm, [Alverio Nunez] could not reasonably anticipate that the deck surface had reached temperatures capable of causing severe second-degree burns within seconds of ordinary contact,' the complaint seen by the Daily Mail stated. Alverio Nunez had allegedly walked only around twenty steps across the Lido deck of the ship, which had departed from Miami, according to the complaint. The deck was said to be 'unreasonably hot,' the documents alleged, further accusing Carnival of failing to warn passengers. 'There were no warnings, signs or notices in the area to alert passengers that the deck was able to become so hot that it could cause second-degree burns in a matter of seconds,' the document said. The complaint also accuses the cruise company of at least 25 similar incidents involving previous customers burning themselves on the hot deck of the cruise ships in the last six years before Alverio Nunez's experience. A further 42 passengers allegedly complained about the temperature of the ships' deck in the same time frame, the complaint stated. Alverio Nunez is accusing the cruise company of negligence, with his injury having caused him a 'severe and life changing injury to his feet and other parts of his body.' His injuries, according to the document, caused the passenger 'pain and suffering, disability, disfigurement, mental anguish, loss of capacity for the enjoyment of life and expense of hospitalization, medical and nursing care and treatment, loss of earnings and loss of ability to earn money and aggravation of a previously existing condition.' 'Plaintiff also lost the value of the cruise and incurred other incidental expenses,' the complaint added. Alverio Nunez is seeking damages of $5 million and a trial by jury. Carnival Corporation said in a statement to USA Today that the company does not comment on pending litigation. The Daily Mail reached out to Carnival Cruises and to Alverio Nunez's legal team for comment. No comments have so far been submitted.
